1. Acceptance of Terms

By accessing or using the PickleGetaways website and platform ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, players, hosts and any other users of the Platform.

If you do not agree to these Terms, you must not use the Platform. Your continued use of the Platform following any changes to these Terms constitutes your acceptance of the updated Terms.

Plain English summary: Using PickleGetaways means you agree to these rules. If you disagree with any part, please stop using the platform.

2. About the Platform

PickleGetaways is an online marketplace that connects players seeking pickleball travel experiences with hosts offering retreats, resorts and private rental properties. We act solely as a marketplace and intermediary between players and hosts.

PickleGetaways is not a party to any agreement, booking or transaction entered into between a player and a host. We do not own, operate, manage or control any retreat, resort or rental property listed on the Platform.

Important: All bookings, payments and agreements are made directly between players and hosts. PickleGetaways is not responsible for the actions, omissions or conduct of any host or player.

3. Accounts

You may browse listings on PickleGetaways without creating an account. To send enquiries or create a listing as a host, you may be required to register for an account.

Account Requirements:

You must be at least 18 years of age to create an account

You must provide accurate and complete information when registering

You are responsible for maintaining the confidentiality of your account credentials

You are responsible for all activity that occurs under your account

You must notify us immediately if you suspect any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive or harmful behaviour.

4. Player Terms

As a player using PickleGetaways to find and enquire about pickleball experiences, you agree to the following:

You will only send genuine enquiries with a real intention to book

You will provide accurate information about your group size, skill level and dates

You will treat hosts with respect in all communications

You will honour any booking agreements made directly with a host

You will not attempt to contact hosts outside the platform to circumvent any future booking systems

You will leave honest and accurate reviews based on your genuine experience

PickleGetaways is not responsible for the quality, safety, accuracy or availability of any listing. Players are encouraged to conduct their own due diligence before committing to a booking.

5. Host Terms

As a host listing a retreat, resort or rental on PickleGetaways, you agree to the following:

All information provided in your listing is accurate, current and not misleading

You have the legal right to offer the accommodation, courts or services described

You will respond to player enquiries in a timely and professional manner

You will honour confirmed bookings made with players through the platform

Your listing complies with all applicable local laws, licences and regulations

You will clearly state your cancellation policy on your listing before any booking is made

You will not post false, misleading or fraudulent content on the platform

Listing Approval: All listings are reviewed by our team before going live. We reserve the right to reject, edit or remove any listing that does not meet our quality standards or violates these Terms, at our sole discretion.

6. Listings and Content

By submitting a listing or any content to PickleGetaways, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce and distribute that content on the Platform for the purpose of promoting your listing.

Content Standards

Content must be accurate, honest and not misleading

Photos must genuinely represent the listing being advertised

Pricing shown must be the actual price guests will pay, excluding any fees clearly disclosed

Content must not infringe any third-party intellectual property rights

Content must not contain offensive, discriminatory or inappropriate material

We reserve the right to remove or edit any content that violates these standards without notice.

7. Bookings and Payments

PickleGetaways facilitates connections between players and hosts. All bookings and payments are agreed and transacted directly between players and hosts outside of the PickleGetaways platform.

PickleGetaways does not process, hold or guarantee any payments between players and hosts

Any payment disputes are between the player and the host directly

Players should confirm all booking details including price, inclusions and cancellation policy with the host before making any payment

PickleGetaways is not liable for any financial loss arising from a booking made through the platform

8. Cancellations

Cancellation policies are set individually by each host and are their sole responsibility. PickleGetaways is not a party to any cancellation or refund agreement between a player and a host.

Players must review and confirm the host's cancellation policy before completing any booking

If no cancellation policy is displayed on a listing, players should request written confirmation from the host before booking

PickleGetaways is not responsible for any refunds or compensation arising from a cancellation

9. Prohibited Conduct

You must not use PickleGetaways to:

Post false, misleading or fraudulent listings, reviews or information

Harass, threaten or intimidate other users, hosts or the PickleGetaways team

Scrape, copy or republish content from the platform without written permission

Attempt to gain unauthorised access to any part of the platform or its systems

Use the platform for any unlawful purpose or in violation of any applicable law

Manipulate reviews, ratings or listing rankings through artificial means

Impersonate any person, business or organisation

Transmit any viruses, malware or harmful code

Violations of these prohibitions may result in immediate account suspension or termination and may be reported to relevant authorities.

10. Intellectual Property

All content on the PickleGetaways platform that is not user-submitted, including the website design, logo, branding, copy and code, is the intellectual property of PickleGetaways and is protected by applicable copyright and trademark laws.

You may not reproduce, distribute, modify or create derivative works from any PickleGetaways content without our express written permission.

User-submitted content such as listing photos, descriptions and reviews remains the intellectual property of the submitting user, subject to the licence granted to PickleGetaways under Section 6.

11. Limitation of Liability

To the fullest extent permitted by applicable law, PickleGetaways and its directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the platform.

This includes but is not limited to:

Any loss or damage arising from a booking made through the platform

Personal injury, illness or property damage occurring during a retreat, resort stay or rental

Financial loss arising from a host cancellation, no-show or failure to deliver services as described

Any inaccuracies or errors in listing content provided by hosts

Any loss of data or interruption of service on the platform

Important: PickleGetaways acts as a marketplace only. We strongly recommend players obtain appropriate travel insurance before travelling to any retreat, resort or rental booked through the platform.

12. Disclaimer

The PickleGetaways platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free or free from viruses or other harmful components.

We make no representations or warranties about the accuracy, completeness or suitability of any listing, host or experience featured on the platform. All listings are created and managed by third-party hosts and we cannot verify every claim made in a listing.

13. Termination

We reserve the right to suspend or terminate your access to PickleGetaways at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to the platform, its users or third parties.

You may close your account at any time by contacting us through the Contact page. Termination of your account does not affect any obligations or liabilities incurred prior to termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, business practices or applicable law. When we make material changes, we will update the effective date at the top of this page and notify registered users by email where appropriate.
