By accessing or using the PickleGetaways website and platform ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, players, hosts and any other users of the Platform.
If you do not agree to these Terms, you must not use the Platform. Your continued use of the Platform following any changes to these Terms constitutes your acceptance of the updated Terms.

PickleGetaways is an online marketplace that connects players seeking pickleball travel experiences with hosts offering retreats, resorts and private rental properties. We act solely as a marketplace and intermediary between players and hosts.
PickleGetaways is not a party to any agreement, booking or transaction entered into between a player and a host. We do not own, operate, manage or control any retreat, resort or rental property listed on the Platform.
Important: All bookings, payments and agreements are made directly between players and hosts. PickleGetaways is not responsible for the actions, omissions or conduct of any host or player.
You may browse listings on PickleGetaways without creating an account. To send enquiries or create a listing as a host, you may be required to register for an account.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive or harmful behaviour.
As a player using PickleGetaways to find and enquire about pickleball experiences, you agree to the following:
PickleGetaways is not responsible for the quality, safety, accuracy or availability of any listing. Players are encouraged to conduct their own due diligence before committing to a booking.
As a host listing a retreat, resort or rental on PickleGetaways, you agree to the following:
Listing Approval: All listings are reviewed by our team before going live. We reserve the right to reject, edit or remove any listing that does not meet our quality standards or violates these Terms, at our sole discretion.
By submitting a listing or any content to PickleGetaways, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce and distribute that content on the Platform for the purpose of promoting your listing.
We reserve the right to remove or edit any content that violates these standards without notice.
PickleGetaways facilitates connections between players and hosts. All bookings and payments are agreed and transacted directly between players and hosts outside of the PickleGetaways platform.
Cancellation policies are set individually by each host and are their sole responsibility. PickleGetaways is not a party to any cancellation or refund agreement between a player and a host.

Violations of these prohibitions may result in immediate account suspension or termination and may be reported to relevant authorities.
All content on the PickleGetaways platform that is not user-submitted, including the website design, logo, branding, copy and code, is the intellectual property of PickleGetaways and is protected by applicable copyright and trademark laws.
You may not reproduce, distribute, modify or create derivative works from any PickleGetaways content without our express written permission.
User-submitted content such as listing photos, descriptions and reviews remains the intellectual property of the submitting user, subject to the licence granted to PickleGetaways under Section 6.
To the fullest extent permitted by applicable law, PickleGetaways and its directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the platform.

Important: PickleGetaways acts as a marketplace only. We strongly recommend players obtain appropriate travel insurance before travelling to any retreat, resort or rental booked through the platform.
The PickleGetaways platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free or free from viruses or other harmful components.
We make no representations or warranties about the accuracy, completeness or suitability of any listing, host or experience featured on the platform. All listings are created and managed by third-party hosts and we cannot verify every claim made in a listing.
We reserve the right to suspend or terminate your access to PickleGetaways at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to the platform, its users or third parties.
You may close your account at any time by contacting us through the Contact page. Termination of your account does not affect any obligations or liabilities incurred prior to termination.
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
We may update these Terms from time to time to reflect changes in our services, business practices or applicable law. When we make material changes, we will update the effective date at the top of this page and notify registered users by email where appropriate.
Your continued use of the platform after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
